Medical Negligence Lawsuits

One of the proposed 2014 ballot measures would require doctors to be tested for drug and alcohol abuse and report positive tests to the California Medical Board. Doctors would also be required to report other doctors that suspected of drug or alcohol impairment that might result in medical negligence. Positive test would result in suspension and an investigation. One of the biggest impacts that this new measure would cause would be the increase on $250,000 cap on pain and suffering damages.

For the past 38 years there has been a cap on “pain and suffering” damages related to medical malpractices suites. The raising of the previous cap is the main target of the bill strategically placed in the brief final sentence of the proposal. The increase would mean that lawyers could potentially gain even bigger profits on in malpractice and other personal injury cases, but to a voter glancing over the measure it just appears to be an attempt to protect patients from drug-addled doctors.
